pollutant permit is an administrative permit with legal significance, one of the eight systems of environmental protection management. It is a system that takes the permit as the carrier and restricts the pollutant discharge rights of pollutant discharge units.

In January 2021, Premier Li Keqiang signed the Order of The State Council of the People's Republic of China (No. 736), which published the Regulations on the Administration of Pollution Discharge Permits and regulated the administration of pollution discharge permits.

Management requirements

The Ministry of Environmental Protection has formulated and published a classified management list of pollutant discharge permits for fixed sources in accordance with the law, specifying the scope of pollution discharge permits to be included in the management and the time limit for application.

Pollutant-discharging units shall hold pollutant-discharging permits in accordance with the law and discharge pollutants in accordance with the provisions of the permits.

Content of pollutant permit

The pollution discharge permit is composed of the original and the copy, the original contains the basic information, the copy includes the basic information, the registration items, the permit items, the letter of commitment and other contents.

Environmental protection departments shall, in accordance with national and local standards for the discharge of pollutants, determine the permitted concentration of corresponding pollutants discharged by pollutants-discharging units at discharge outlets or from unorganized discharge sources.

The environmental protection department shall, in accordance with the accounting method for the allowable emissions of key pollutants in the industry stipulated in the application for pollutant discharge permits and the technical specifications for the issuance of pollutant discharge permits, determine the allowable emissions of pollutant discharge units in accordance with the requirements for the improvement of environmental quality.

The discharge permit shall take effect from the date on which the permit decision is made. The first permits are valid for three years, and the renewal permits are valid for five years.
